Dealing with tenants can be quite worrisome especially if your tenant turns out to be thickheaded. It is not easy to deal with them nor an impossible task to do. Therefore, first things first, gear yourself for all the challenges and shortcomings that come in a package of a property owner or simply hire the best property agent to find you a good tenant.

Being said that, one of the main issues is the eviction of a tenant, which seems easy but also gets very challenging when your tenant is not-coming-slow type. Further, the reluctance of the homeowner to pay rent usually stems from most of the evictions. There are other reasons why you would want to effectively evict a tenant because you cannot ignore certain disruptions any longer, such as:

  • Overstaying on the premises without renewal of the contract.
  • Causing property damage.
  • Non-payment of rent.
  • Using residential premises for commercial motives.
  • Violation of the tenancy rules.
  • Violation of pet policy.

Learn the rental act

Make sure you understand the different provincial laws governing the area in which you rented your Rental Property.

Such actions specify the prerequisites for renting and selling as well as ending it, thereby read the relevant papers after constructing them and before beginning an eviction.

Give notice:

You will inform the occupant before the eviction is carried out by the court. In Pakistan, the duration of legal notice does not typically differ by province and is normal for two months. The warning is given to vacate the property with the procedure to evict the tenant is clearly indicated.

Raise the Rent:

Are your tenants irritating but they don't breach your lease? Maybe they are insane or call you every other day to come and change your light bulb.

If your renters do not violate the tenancy intentionally, but just do not want to rent to them again, consider increasing the price – substantially – the next time their contract is extended.

File your eviction:

Property courts for such issues are typically pursued within Pakistan. In order to start the method, you are usually fined. Once the documents have been finished, the court will notify the tenant of the hearing date.

Getting ready for court:

Gather every document you have (preferably in chronological order) (e.g., the agreement, copy of the notice you sent, records of all communication with the tenant and if required bank statements). You can also discuss what you claim before the court on the day of the trial to rehearse it. Do not take any details out. It is a good idea to be organized because it is going to help you.

Evict the tenant:

You will be instructed on how to evict the tenant after the court case has been resolved in your favor. The court should grant the defendant some time to clear the house. If the occupant does not yet step out, the police will help him drive the house down.
